For long, there has been a debate on whether adultery should be regarded as a crime as it is under Indian laws. Finally, the argument seems to be going in favor of those against this social malaise being treated as a criminal act.The draft National Policy on Criminal Justice, authored by the Madhava Menon committee, has responded to the demand of the National Commission for Women (NCW) to de-criminalize adultery by recommending that it should be treated as a social rather than a criminal offence.
Like many others I firmly believe that this is a bold move and that too in the right direction.
National Commission for Women (NCW) is often flaked by many, especially by organizations such as the Save Indian Family Foundation and the likes. And I guess they have their reasons - some valid ones and some at times simply exaggerated.
Some have argued that treating Adultery as a civil offence will only encourage people to commit such acts due to lack of any grave legal implications added to it. Frankly speaking this reasoning is something I really can't figure out. Firstly, since Adultery is perceived as sexual intimacy between consenting adults in private then on what basis can one be imprisoned for that. Secondly, if someone desires to have consensual sex or an affair outside marriage they will do so irrespective of the fact that their very act could land them in prison. And most importantly, a marriage which is held together because of legal complications and nothing else is just not worth it in the first place.
Therefore, it only makes more sense to term it as a civil offence and not a criminal one. Adultery should be considered a valid and strong ground for divorce and the victim should be suitably compensated.
But what totally irks me about Ms Girija Vyas and her clan's proposed plan is that it is totally soaked in gender-biased attitude.
NCW has opposed a proposal to amend Section 497 to bring women also under the purview. IPC says the wife shall not be liable even as an abettor, based on the reasoning that a woman involved in illicit relationship with a married man is a victim rather than author of the 'crime'.
What the fuck?
On one hand, NCW recently announced Domestic Violence Act 2005, a move that appeared to be in grip with today's time and social reality with the inclusion of Live-in Relationships, sexual abuse of children, plight of women who are forced to marry against their wishes and women's right to secure housing.
Then why is she reluctant to hold the adulterous woman equally blameworthy as the adulterous man? Under what context are such women described as 'Victims'? It's like they are deliberately turning a blind eye to the face of reality under the pretext of women's victimhood.
Why is it so hard to play a fair game or at the least try to?

When a married woman has given 'consent' to have sexual intercourse with an outside man, then on what basis this married woman be considered a victim? Victim of what? Are we not capable to understand the significance of the word 'consent'?
Besides, it is common these days where an outside man is responsible to give the 'consent' to a married woman's sexual proposal. Women's sexual nature is not even acknowledged by the law and men are considered sexual beasts.
No problems! Men will suffer from this law but women too are not going to enjoy themselves because women have already lost all that credibility and respect that they enjoyed for many centuries.

The intention(bias) behind making highly Adultery gender biased is the same as one which operates when making laws like 498A and DV act gender biased.
Feminist doctrine is
"A woman = A victim" and vice versa.
Justice for men...wow!!! what does that mean???
Abuse of men...Ha ha ha...Too many jokes too less time?
As for arguments for making adultery a civil offense (rather than criminal one) why not instead make divorce a less painful and easier option then. If somebody is so unsatisfied with marriage why not he/she opt for divorce. Let us make divorce easier.
But remember for making divorce easier, you will have to modify laws and bias(in favor of women) with regard to alimony, maintenance and other women laws which in principle (at least) treat all men as bonded acquiescent labourers, ATMs and criminals by default.

Behaviour of NCW is not at all surprising.
It is interesting to note that, no one from Media or so called progressivists are pointing at such illogical and irrational behaviour of NCW. May be they all assume it is perfectly OK to follow all kinds of unbalanced and illogical behaviour when the cause is noble and politically correct.
NCW got the Domestic Violence Law drafted by an organisation called Lawyer's collective (which claims itself to be a Human Rights Organisation, but in reality it is a radical feminist/communist organisation).
Within 2 months of implementation of DV Act, Supreme Court called the DV act "Poorly Drafted" and warned that this kind of Drafting will lead to "Social Chaos".
Now, Lawyer's Collective is busy drafting the "Workplace Harassment" Law.
There are many criminal laws which are not gender neutral (in theory or in practice).
1) Abettment to suicide law.
2) Dowry/Sowry Law. (DP Act)
3) Cruelty Law (498a).
4) Adultery Law.
5) Domestic Violence Law.
6) Child Custody Laws.
7) Maintenance Laws.
The whole idea is to fleece men and if possible boys with continous bombardment of sob stories in media and other communications channels like TV, Advertisements.
Even in KBC, SRK has got politically correct overtones. In one occassion he says, Indian men should always put their wives/girlfriends above their mothers/sisters.
Has he got any data or statistic to prove that Indian men do not treat all of them equally? or has he simply gone with propaganda or instructions by producers?
Goebbels will come to a poor second compared to what radical feminists are doing in India and world.
Recent reports say, children in US and UK are much worse off compared to children in many other countries. The governments are encouraging couples to sort out their differences for the sake of children as children from fatherless families have 60% greater chance to commit suicide and 4 times more chance to have emotional/behavioural problems.
Now, NCW wants money for DV Shelters all over India. Its sure many of these (if they come) will become brothels.
Even though Govt takes 33% tax, there is no social security system in this country and not institutional care for abandoned elderly people.
The judges in the meanwhile do not want anyone to hold them to account. It seems their "self respect" will get hurt if someone asks them about their assets.
It is perfectly OK if self respect of an elderly woman is hurt while getting jailed in a false case.
We have got a new set of castes now who only have got self respect and whose words are the words of God "Adulterous women are victims" (as claimed by NCW).
Every victim must get compensation.
So, what compensation does NCW plan to seek for women who commit adultery?
This country has gone to dogs as the intellectuals only indulge in Analysis (which leads to paralysis) and do not go to vote.
Then they read ToiLet papers and watch biased media.

Adultery as a crime is a very strange concept. It is similar to the statement about restitution of conjugal rights where a person could go to court so that their spouse is forced to start living with them.

The reason why women find making adultery not an offense while men are something to with the concept of men being treated as success object . It is very rare for men to go into a long term relationship with women as second husband where as we find many women in relationship as second wives.
This means that there will be support from women for adultery since they do not mind being a second , third wife of successfull husband where as men defnitely mind being so.
Either social conditioning or genetic programming we do not know
so powerfull men which includes MPs MLAS find it attractive. Unpowerfull men like middle class men do not .
It means that a few men have multiple relationships while lessor number of women have multiple relationship.
It is not surprising since I have seen many 498a men having wifes who have adulterous relationship with powerfull politicians.
This explains the opposition to allowing evidence to play a role in cognising or charging 0f 498a and favour of powerfull men and most women towards adultery
